Attorney Fabisch argues sex and race discrimination case against the Rhode Island Attorney General's Office, wins client's right to proceed.

Fabisch Law client Dawn Huntley, a Rhode Island Attorney who had previously spent time as a prosecutor in the attorney generals office, has been allowed to proceed with her racial and sexual discrimination case against the Rhode Island Attorney General's Office after a ruling by the Presiding Justice of the Rhode Island Superior Court. The Attorney General's office had sought to have the case dismissed on technical grounds because the plaintiff's old attorney had initially filed an action in the United States District Court but then failed to follow up on the matter which was ultimately dismissed. Huntley then sought out attorneys Matthew Fabisch and Nicholas Gelfuso to bring an action in the state courts. When the Attorney General's office then sought to dismiss the case based on the earlier federal court action, Attorney Fabisch argued that the earlier case was not an adjudication on the merits and that Huntley was entitled to her day in court. In November, the Court issued an opinion holding that Huntley's case could move forward. Full text of the court's opinion is available here.
