Chapter 13 Bankruptcy
The "Wage Earners Plan"

Picture
Chapter 13 bankruptcy is available to allow a debtor who underwent a period of financial distress, but has a job and is earning wages, or who does not qualify to file a Chapter 7 bankruptcy, a chance to work out a plan over a period of 36 – 60 months. Though the discharge in a Chapter 13 case is not obtained until completion of the plan, a particular advantage of Chapter 13 is that it provides individual debtors with an opportunity to save their homes from foreclosure by allowing them to "catch up" past due payments through the payment plan
