Managing Attorney, who also serves as the President and General Counsel for Rhode Island's Stephen Hopkins Center for Civil Rights, was quoted in this week's Providence Phoenix commenting on the historical origins of the arguments raised in the briefing of Rhode Island Governor Chafee's arguments before the United States First Circuit Court of Appeals in the Pleau Murder/Extradition case. The Hopkins Center had previously submitted a brief in the case arguing that the Governor's position should prevail, but because the Federal Government did not have the power to prosecute the case, not, as the Governor had argued, because of a historical "right to refuse" to extradite. ]]>Fri, 02 Dec 2011 03:04:05 GMThttp://www.fabischlaw.com/1/post/2011/12/attorney-fabisch-argues-sex-and-race-discrimination-case-against-the-rhode-island-attorney-generals-office-wins-client-right-to-proceed.htmlFabisch Law client Dawn Huntley, a Rhode Island Attorney who had previously spent time as a prosecutor in the attorney generals office, has been allowed to proceed with her racial and sexual discrimination case against the Rhode Island Attorney General's Office after a ruling by the Presiding Justice of the Rhode Island Superior Court. The Attorney General's office had sought to have the case dismissed on technical grounds because the plaintiff's old attorney had initially filed an action in the United States District Court but then failed to follow up on the matter which was ultimately dismissed. Huntley then sought out attorneys Matthew Fabisch and Nicholas Gelfuso to bring an action in the state courts. When the Attorney General's office then sought to dismiss the case based on the earlier federal court action, Attorney Fabisch argued that the earlier case was not an adjudication on the merits and that Huntley was entitled to her day in court. In November, the Court issued an opinion holding that Huntley's case could move forward. Full text of the court's opinion is available here.
